What is the Difference Between 1st and 2nd Degree Murders in Florida?
Murder charges are defined by the following degrees:
- First Degree Murder: This includes premeditated murder or felony murder. Premeditated murder occurs when one person kills another person as the result of a planned out scheme. Felony murder occurs when one person intentionally or unintentionally kills another person as the result of carrying out or attempting to carry out a different felony crime.
- Second Degree Murder: This includes murder with a depraved mind or accomplice felony murder. Murder with a depraved mind occurs when one person kills another person without premeditation, but during an act that shows blatant disregard for the safety of other human lives. Accomplice felony murder occurs when a person is an accomplice in committing a felony crime that results in death.
- Third Degree Murder: This includes killing another person while attempting to carry out a non-violent felony. An exception to this is if a person provided drugs that led to the victim's death. In this case, the crime may be charged as first degree murder.
