Understanding Stalking and the Penalties in Florida

Section 784.048 of the 2015 Florida Statutes defines stalking as the willful, malicious following, harassing, or cyberstalking of another individual. Often, criminal charges of stalking occur in conjunction with criminal charges of domestic violence—meaning that many individuals do not solely face the penalties associated with stalking.

Should you be accused of stalking alone, you will face a first-degree misdemeanor, which is punishable by:

  • Up to 1 year of imprisonment
  • A maximum fine of $1,000

Should you be accused of stalking an individual and making a credible threat against another person, the crime could be elevated to aggravated stalking, which is a third-degree felony punishable by imprisonment up to 5 years and a maximum fine of $5,000.
